JibPack Terms and Conditions
JibPack, operated by JibPackDAO, is a platform offering various services (the “Interface”).
Please read these terms and conditions carefully before using the Interface. Your use of the Interface is conditional upon your agreement to the Terms set out below. If you do not agree or do not consent to be bound by these Terms, do not use the Interface.
If you do not meet the eligibility requirements set forth in Section 7 of the Terms or are otherwise not in compliance with these Terms, you are prohibited from using the Interface. The use of methods such as VPNs by ineligible persons to access the Interface is prohibited and may result in legal liability.
Terms of Use
These Terms of Use and any incorporated terms (collectively, "Terms") govern access to and use of the Interface by users ("User" or "You"). By accessing the Interface, or by acknowledging your agreement to these Terms, you consent to be bound by all Terms, Privacy Policy, and Disclosure.
You agree to a binding arbitration provision and a class action waiver impacting how disputes are resolved.
The Terms may be changed without notice. Continued use of the Interface following such changes constitutes acceptance of the revised Terms.
- 1. Dispute Resolution; Arbitration Agreement
Any disputes related to the Interface must first be addressed through informal negotiation. Unresolved disputes will be settled by arbitration administered by the London Court of International Arbitration under their rules. The arbitration will be in English and confidential. The decision may be enforced in any competent court.
- 2. Class Action and Jury Trial Waiver
You consent to address any disputes or claims related to the Interface solely in your personal capacity, not as a representative or member of any class or collective legal action, nor as part of any private attorney general or other representative proceeding. Additionally, you unequivocally forgo any right to a jury trial in such matters.
- 3. Governing Law
These Terms are governed by the laws of the Cayman Islands.
- 4. About the Interface
The Interface aggregates third-party information about liquid staking technology and allows users to interact with Middleware for transactions.
- 5. About the Middleware
Middleware, based on Lido Smart Contract Protocols, is compiled to bytecode associated with specific public addresses on blockchains.
- 6. Interface relationship to Middleware
The Interface is independent of blockchain systems, wallets, validator nodes, and Middleware. It aggregates publicly available information in a user-friendly format.
- 7. Eligibility and RepresentationsBy using the Interface, you represent and declare that you:
- Are of legal age in your jurisdiction to use the Interface and the Middlewares, and possess the legal capacity to agree to these Terms.
- Possess the necessary technical knowledge to understand and evaluate the risks of using the Interface and the Middlewares.
- Comply with all applicable laws, rules, and regulations in your jurisdiction, and your use of the Interface does not violate or facilitate illegal activities.
- Are not a U.S. person, nor located, resident, incorporated, or organized in the United States of America.
- Are not a resident, citizen, national, or agent of, nor an entity in, any Restricted Territory subject to embargoes or sanctions by Major Jurisdictions.
- Do not own or control, nor have received assets from, any blockchain address on sanctions lists maintained by Major Jurisdictions.
- Do not intend to transact in or with any Restricted Territories or Sanctions List Persons.
- 8. Permitted Use
The Interface is intended solely to assist users who are technologically proficient and seek to use it only for informational purposes, aiding their personal research, diligence, and decision-making. Users are responsible for independently verifying the accuracy of any information obtained from the Interface, including draft transaction messages, and ensuring that it aligns with their intended transactions before use.
- 9. Prohibited Uses
Users must not engage in illegal activities, fraud, deceit, unauthorized access, or other prohibited actions.
- 10. Additional User Declarations
You agree to the limitations of the Interface's duties and accept its role as an informational tool.
- 11. Certain Risks
You acknowledge and assume risks associated with the Interface, including operational and technology risks.
- 12. License to Use Interface
Users are granted a personal license to access and use the Interface as per these Terms.
- 13. Privacy Policy
The Interface may collect personal information for operational purposes, subject to applicable laws.
- 14. Non-Reliance
Users should independently verify information from the Interface and not rely solely on it for decision-making.
- 15. Risks, Disclaimers, and Limitations of Liabil1ty
Users acknowledge risks associated with third-party offerings, cryptography, forks, software dependencies, tax issues, and disclaimers' legal limitations.
- 16. Entire Representation, Consent, and Agreement
These Terms constitute the entire agreement regarding the Interface.
